benchli Terms and Conditions
Effective date: 19 October 2026 Last updated: 19 October 2026 Product: benchli (mobile apps + web) Operator: Mitbolas GmbH Registered address: Asylstrasse 26, 8800 Thalwil, Switzerland Contact email: benchli_operations@benchli.com
These Terms and Conditions ("Terms") govern your access to and use of the benchli apps, websites, APIs, services, content, features, and integrations (together, the "Service").
You accept these Terms by confirming your acceptance when you complete your account. benchli records which version you accepted and when. If you use a part of the Service without an account, such as answering an invitation through a link in an e-mail, the page shows you a link to these Terms and to the Privacy Policy before you answer, and your answer is your acceptance of these Terms for that use. Receiving or opening an e-mail or an invitation is not acceptance. The Terms are available at https://benchli.com/legal.
If you do not agree to these Terms, you must not use the Service.
1. About benchli
benchli is a digital platform designed to help non-professional and community sports teams, players, managers, coaches, clubs, leagues, and organizers manage team operations.
The Service may include features such as:
- player profiles;
- team creation and management;
- game, event, tournament, and competition management;
- RSVP and availability tracking;
- team feeds, tasks, polls, and announcements;
- statistics and participation tracking;
- digital player cards;
- guest player marketplace functionality;
- support and feedback tools;
- payment, invoicing, and subscription features;
- image upload and validation;
- AI-assisted support, feedback analysis, retrospectives, and team insights;
- optional integrations with third-party services.
benchli is built for amateur, recreational, community, and semi-professional sports use. It is not intended to replace professional legal, financial, medical, coaching, safety, or compliance advice.
These Terms are supplemented by the benchli Privacy Policy and, whenever benchli processes a team's data for a team, club, league, or organization, by the benchli Data Processing Addendum (the "DPA"). The person who creates a team accepts the DPA for it (Section 4). Where the DPA and these Terms conflict on the processing of personal data, the DPA applies. All three documents are available at https://benchli.com/legal.
benchli is offered from Switzerland and can be used anywhere. Some features, in particular paid plans and payment collection, are available only in the countries stated on our pricing page (Section 11).
2. Who may use benchli
You may use benchli only if:
- you are legally able to enter into these Terms;
- you are at least 18 years old, unless a higher age is required in your country;
- your use of the Service complies with applicable laws;
- you are not prohibited from using the Service under applicable law;
- you provide accurate information when creating or maintaining your account.
If you are using benchli on behalf of a team, club, league, organization, or company, you confirm that you have authority to act on behalf of that organization.
If you invite players or other users to benchli, you are responsible for ensuring that you have a lawful basis and appropriate permission to contact them.
3. Account registration and security
To use certain features, you may need to create an account or verify your identity using a login code, magic code, email verification, mobile authentication, or another authentication method.
You agree to:
- provide accurate and current information;
- keep your account information up to date;
- protect access to your email, device, and account;
- not share login codes or authentication credentials;
- notify us promptly if you suspect unauthorized access.
You are responsible for activity that you authorize through your account, and for loss caused by your breach of the obligations above. You are not responsible for unauthorized use that you could not reasonably have prevented. Nothing in this section limits your mandatory rights, including rights concerning unauthorized payments, or benchli's responsibility for its own acts and omissions.
We may suspend or restrict account access where we reasonably believe there is unauthorized use, misuse, fraud, security risk, or breach of these Terms.
4. User roles and team permissions
benchli may support different roles, including players, team managers, captains, coaches, owners, league organizers, administrators, finance officers, and other role types.
Certain users may have permission to:
- create or manage teams;
- invite or remove players;
- update team settings;
- manage events and games;
- view player availability;
- manage RSVPs;
- upload statistics;
- create polls;
- send announcements;
- manage billing or payments;
- access team reports or analytics.
You are responsible for assigning appropriate roles within your team or organization.
Teams are responsible for their own governance and sporting decisions, including permissions, selection, playing time, fees, availability, and membership. benchli does not decide disputes between team members, managers, clubs, leagues, or organizations about those matters. This does not exclude benchli's responsibility for its own acts and omissions, including how the Service's access controls work and its obligations under the DPA and applicable law.
Creating a team. When you create a team you accept the DPA on behalf of your team, club, league, or organization, and you confirm that you are authorized to do so. benchli records which version you accepted, and when; you can see this in your team's settings. If your team belongs to a club or organization that is a legal person, such as a company or an association with legal personality (with or without an entry in the commercial register), that club or organization is the Club under the DPA and is responsible for the team data; you are not personally responsible for it merely because you created the team. If neither your team nor any club or organization behind it is a legal person (for example, a group of friends who play together informally, without an association or company of their own), you are personally responsible for the team data of that team, including what your co-managers enter, as described in the DPA.
5. Team and player information
Users may provide information such as:
- name;
- email address;
- phone number, if supported;
- profile photo;
- year of birth;
- preferred language;
- preferred jersey number;
- team membership;
- player status;
- RSVP status;
- availability;
- statistics;
- team role;
- event participation;
- support messages;
- feedback;
- other information submitted through the Service.
You confirm that the information you provide is accurate and that you have the right to provide it.
Team managers and organizers must ensure that information they upload about players or team members is accurate, appropriate, and lawfully submitted.
6. Photos, profile images, and media uploads
benchli may allow users to upload profile images, team logos, event images, documents, voice notes, written notes, or other media.
By uploading content, you confirm that:
- you have the right to upload and use that content;
- the content does not infringe anyone else’s rights;
- the content is not unlawful, abusive, discriminatory, misleading, or harmful;
- the content does not contain confidential information that you are not authorized to share.
benchli may use automated or manual checks to validate uploaded images, including checking whether a profile image appears to contain a real person’s face.
We may reject, remove, crop, resize, restrict, or delete uploaded content where necessary for product functionality, safety, compliance, moderation, or technical reasons.
You remain responsible for the content you upload.
7. Voice notes, game notes, and retrospective features
benchli may allow users to submit written notes, voice notes, post-game feedback, ratings, observations, or similar content.
These inputs may be used to generate:
- team retrospectives;
- player-facing summaries;
- manager-facing summaries;
- action items;
- support or feedback insights.
You should not submit content that is unlawful, abusive, defamatory, discriminatory, harassing, invasive of privacy, or unrelated to legitimate team purposes. Do not record or upload a conversation with other people without their consent where the law requires it, and never submit a covert recording. If a recording contains another person's voice, make sure that person knows about it and that you are allowed to share it.
Where voice notes are used, they may be transcribed, translated, summarized, normalized, or processed using third-party technology providers.
AI-generated summaries may be incomplete, inaccurate, or require human review. They should be treated as assistance, not as final truth.
8. AI-assisted features
benchli uses a third-party AI service — Amazon Web Services (AWS) Bedrock (currently the Amazon Nova Lite and Amazon Nova 2 Lite models, in the EU, as described in Section 7 of the Privacy Policy) — to support a small set of assistive, mostly operational features, such as:
- support triage and knowledge-base suggestions;
- product feedback scoring and duplicate detection;
- summaries, retrospectives, translation, and transcription;
- moderation and admin support workflows.
The main user-facing feature is the optional "propose a lineup" suggestion, which a manager can trigger to receive a suggested team lineup.
AI outputs are generated from available data and may be wrong, incomplete, outdated, biased, or inappropriate for your specific context. You agree that:
- AI-generated content is provided for convenience and decision support only;
- team managers and users remain responsible for the decisions they make;
- AI outputs should be reviewed before being relied upon;
- benchli does not guarantee that AI outputs will be accurate, fair, complete, or suitable for any specific purpose.
benchli does not use AI to make decisions that have legal or similarly significant effects on you without human involvement. benchli may log AI interactions and related metadata to improve reliability, safety, quality, and auditability.
9. Guest player marketplace
benchli may include features that allow teams to identify, invite, or manage guest players or substitute players.
The guest player marketplace is intended to help teams address roster gaps, last-minute availability issues, and team participation needs.
A player appears in guest search only if the player has switched on their own guest profile, and can switch it off at any time. Teams searching see limited details, such as the player's first name and general area, never the player's address.
You agree that:
- teams are responsible for deciding whether a guest player is suitable;
- players are responsible for the accuracy of their own availability and profile information;
- benchli does not guarantee player reliability, skill level, eligibility, safety, identity, background, insurance status, or fitness to participate;
- teams, clubs, leagues, and organizers remain responsible for applying their own rules, checks, eligibility standards, and safety procedures.
benchli may restrict, suspend, or remove marketplace access where misuse, abuse, fraud, safety concerns, or repeated unreliability is detected.
10. Sports participation, safety, and health
benchli is not a medical, health, coaching, or emergency service.
The Service may display information related to participation, activity, attendance, games, events, statistics, or availability. Such information is for team operations and personal convenience only.
You should not rely on benchli for:
- medical advice;
- injury assessment;
- emergency response;
- player fitness clearance;
- return-to-play decisions;
- safeguarding decisions;
- insurance coverage confirmation;
- legal eligibility decisions.
You may choose to record that you are injured. benchli stores the status and the expected return date, not a note or any medical detail: do not enter diagnoses, treatment details or medical certificates anywhere in benchli. Do not record another person's health information unless you are a manager marking it in your team's attendance records and your team has that person's explicit consent for it. Your team, not benchli, is responsible for asking for that consent and keeping a record of it, and the person can withdraw it at any time. benchli does not use this information for medical advice or return-to-play decisions.
Players participate in sports at their own risk and according to the rules, safety standards, and house rules of their team, league, venue, or organizer.
11. Payments, subscriptions, and billing
benchli may offer paid subscriptions, team plans, league plans, paid add-ons, transaction features, invoicing, payment collection, refunds, platform fees, or third-party payment integrations.
Payment terms may vary depending on:
- country;
- currency;
- team type;
- league arrangement;
- plan type;
- promotional offer;
- payment provider;
- app store rules;
- contract terms.
Where payments are processed by third-party payment providers, app stores, banks, card networks, or other financial intermediaries, their terms may also apply.
Unless otherwise stated:
- subscription fees are billed in advance;
- fees are non-refundable except where required by law or expressly stated;
- taxes may apply;
- team owners or billing administrators are responsible for maintaining accurate billing information;
- failure to pay may result in restricted access, suspension, or cancellation.
Plan term, renewal, and cancellation. A subscription bought from benchli runs for one year from the day you buy it and renews automatically for a further year, each year, at the price it was bought at or a lower price if we have lowered it, until you cancel its renewal. A plan bought with a one-time payment runs only for the term shown before you pay and then ends by itself: it never renews and you do not need to cancel it. Before you pay, we show you the price, the term and whether the plan renews. You can cancel a subscription’s renewal at any time in HQ or by contacting us. The cancellation takes effect at the end of the year you have paid for and you keep your plan until then. We do not refund the part of a term that remains, except where these Terms or the law give you a refund. If you are a consumer and the law of your country gives you a right to end a renewed plan sooner, or on shorter notice, that right applies. If a plan was bought for a team and the person who pays deletes their account, or the team is closed, the plan ends at the end of the term already paid and does not renew.
Where you can pay. Paid plans can be purchased by teams anywhere our payment provider can lawfully process the payment. We cannot accept payments from countries, persons or organisations that are subject to sanctions or that our payment provider does not support. If our payment provider does not support your country or payment method, you can still create a team and use the free features, where providing the Service to you is lawful. Where sanctions or other legal restrictions require it, we may restrict free as well as paid access.
Prices include the value-added, goods-and-services or sales tax that applies in your country where the law requires it, and the tax is stated on your invoice. The applicable tax is determined from the billing details you give us, so they must be accurate and complete; we may ask you to correct them before a payment is accepted. If you provide a valid business VAT or tax number, the rules for business customers in your country apply.
If purchases are made through Apple App Store or Google Play, the relevant app store’s payment, cancellation, and refund rules may apply.
The price of a subscription that is running does not go up while it renews: it keeps the price it was bought at. benchli may change plan features and billing terms for new purchases and renewals. We give at least 30 days' notice of a change that makes a paid plan materially worse for you, and you can cancel before it takes effect. A change that is needed immediately to comply with the law or to address an urgent security risk may take effect sooner, with notice as soon as practicable. Your mandatory consumer rights are not affected.
12. Team finances and platform records
benchli may provide tools for team finance management, expense tracking, invoicing, payment reconciliation, ledger-style records, or platform transaction reporting.
These tools are provided to assist with team administration only.
When a player pays a team fee or dues through benchli, the payment is owed to the team, not to benchli. It goes to the team's own Stripe account (or another payment provider's equivalent), and the team decides on any refund of it. benchli provides the tools; the payment provider processes the payment.
benchli does not provide accounting, tax, legal, audit, or financial advice.
A team, and the people authorized to administer its finances, remain responsible for the team's own:
- tax compliance;
- bookkeeping;
- player fee collection;
- refunds;
- financial reporting;
- legal obligations;
- review of financial records;
- compliance with local laws.
Individual users are responsible only for their own obligations. This section does not change benchli's responsibility for its own charges, invoices, refunds, processing of personal data, or performance of the Service.
13. Notifications and communications
benchli may send communications through:
- push notifications;
- email;
- in-app messages;
- SMS, if supported;
- team feed updates;
- system alerts;
- transactional messages.
These may include:
- login or verification codes;
- RSVP links;
- team invitations;
- game reminders;
- event updates;
- support responses;
- payment notices;
- security alerts;
- product updates;
- administrative messages.
Some communications are necessary for the Service to function and cannot be fully disabled while using relevant features.
Necessary communications are security, billing, and material account notices; they do not include promotion. Product updates and other marketing are sent only if you have opted in or the law otherwise allows, and you can opt out at any time with the unsubscribe link or by contacting us. Push notifications need your permission and can be turned off in your device settings.
You may be able to manage optional notification preferences in the app or through your device settings.
14. Fast action links
benchli may support fast action links, such as RSVP links sent by email or notification.
These links may allow a user to take a specific action without completing a full app login.
Fast action links may be:
- signed;
- time-limited;
- single-purpose;
- tied to a specific player, team, event, game, or action;
- auditable.
You must not forward, sell, share, manipulate, or misuse action links.
If a link expires, fails validation, or appears suspicious, benchli may require normal login or additional verification.
15. Acceptable use
You must not use benchli to:
- break the law;
- infringe intellectual property rights;
- harass, threaten, abuse, bully, defame, or discriminate against others;
- upload unlawful, hateful, violent, explicit, exploitative, or harmful content;
- impersonate another person;
- misrepresent your identity, role, team, organization, or eligibility;
- interfere with the Service;
- attempt to bypass security controls;
- reverse engineer the Service, except as the law allows despite this restriction; scrape, overload, probe, or attack the Service;
- upload malware or harmful code;
- misuse APIs;
- create fake accounts;
- manipulate polls, RSVPs, statistics, payments, or marketplace signals;
- collect personal data from other users without authorization;
- use benchli for professional gambling, betting, or unlawful wagering;
- use benchli to make automated decisions that unlawfully affect individuals.
We may investigate suspected misuse and take action, including restricting access, removing content, suspending accounts, notifying affected users, or reporting unlawful activity.
16. User content and licence to benchli
You retain ownership of content you submit to benchli, subject to any rights held by your team, club, league, organization, or other parties.
By submitting content, you grant benchli a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, display, transmit, adapt, translate, summarize, analyze, and use that content as necessary to operate, secure, improve, and provide the Service.
This licence includes use for:
- team operations;
- app functionality;
- support;
- analytics;
- AI-assisted features;
- moderation;
- backups;
- compliance;
- audit logging;
- security.
We do not claim ownership of your content. This licence concerns intellectual property rights only; it is not your consent to, and not a legal basis for, the processing of personal data. Personal data is processed as the Privacy Policy describes and, for a team's data, only on the Club's instructions under the DPA, which applies if it conflicts with this licence. Content you submit to an AI-assisted feature is used only to provide that feature, as Section 7 of the Privacy Policy explains.
When your account is deleted or your team membership ends, your membership record is removed. What remains is limited to the purposes and periods in Section 12 of the Privacy Policy, such as payment records, audit and security records, and anonymized team history. The licence above continues only for as long as that retained content needs it.
17. benchli intellectual property
The Service, including the benchli name, branding, software, design, logos, features, workflows, databases, APIs, documentation, text, graphics, and platform structure, is owned by or licensed to benchli.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Service unless expressly permitted by us in writing or allowed by law.
You may use benchli only as permitted by these Terms.
18. Third-party services and integrations
benchli may integrate with third-party services, including:
- payment providers;
- cloud infrastructure providers;
- app stores;
- analytics tools;
- email providers;
- authentication providers;
- AI providers;
- transcription or translation providers;
- insurance or travel partners;
- calendar services;
- notification services;
- sports technology providers;
- customer support tools.
Third-party services may have their own terms, privacy policies, fees, limits, and availability.
benchli is not responsible for the independent performance of third-party services that you contract with separately. This does not exclude benchli's responsibility for its own obligations or for providers it engages to perform them, including its responsibility for sub-processors under the DPA and applicable law.
We may add, change, suspend, or remove integrations. Changes to sub-processors follow the notice and objection procedure in the DPA, and a change to an integration that is part of a paid plan remains subject to the change, cancellation and refund terms in Section 11. Optional integrations that share personal data are disclosed before they are switched on.
If you connect an AI assistant to your account, you decide what it may see and do within the options benchli offers. You are responsible for the permissions you give it and for what you ask it to do. You are not responsible for what its provider does on its own, outside what you approved. This does not limit benchli's own duties to enforce the permissions you approved and to secure the connection. You can disconnect at any time.
19. Beta, pilot, and experimental features
Some features may be released as beta, pilot, preview, early access, or experimental functionality.
These features may:
- contain errors;
- change without notice;
- be removed;
- have limited support;
- produce incomplete or inaccurate outputs;
- be available only to selected users, teams, leagues, or regions.
You use beta or experimental features at your own risk. A beta or experimental label does not reduce our data protection and security obligations, exclude liability that cannot lawfully be excluded, or remove rights you have under mandatory law. A beta label does not override what we promise when you buy a plan: for a beta feature that is part of a paid plan, changes and removal follow Section 20, including its notice.
20. Service availability and changes
We aim to provide a reliable Service, but we do not guarantee uninterrupted availability.
The Service may be affected by:
- maintenance;
- upgrades;
- outages;
- security incidents;
- third-party failures;
- infrastructure issues;
- network failures;
- app store delays;
- legal or regulatory requirements;
- force majeure events.
We may change, suspend, restrict, or discontinue parts of the Service to comply with the law, to address a security risk, to keep the Service working with other technology, or to improve or run it. A change does not add a charge to a plan you have already bought. We give reasonable advance notice of a material restriction or discontinuation, directly (for example by e-mail) and in a form you can keep, except where the law or an urgent security risk requires immediate action. Where lawful and safe, you can export your data before access ends.
21. Suspension and termination
We may suspend or terminate your access to the Service if:
- you breach these Terms;
- your use creates a concrete legal or security risk;
- your account appears compromised;
- you misuse the Service;
- required payments are not made;
- continued access would violate law or third-party rights;
- we discontinue the Service or a relevant feature.
We act only as far as is proportionate. Where reasonably possible we tell you why and give you a chance to put the problem right before we end your access; we may suspend access at once where that is needed for an urgent risk or a legal requirement. You can ask us to review a decision by contacting us.
You may stop using the Service at any time.
Stopping use does not by itself cancel a subscription. You can delete your account in the app or by contacting benchli_operations@benchli.com. If you pay for a team's plan and delete your account, the plan is cancelled at the end of the term already paid, and the team's owners are told. If you are the only owner of a team that has other members, transfer ownership or contact us before you delete your account, as Section 14 of the Privacy Policy explains. That does not stop you from cancelling your plan's renewal at any time.
Termination does not affect rights or obligations that should reasonably continue, including charges that have already fallen due, ownership rights, disclaimers, liability limits, audit records, and dispute provisions.
22. Disclaimers
The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, benchli does not guarantee that:
- the Service will be uninterrupted or error-free;
- all data will be accurate, complete, or current;
- AI-generated outputs will be correct;
- statistics or analytics will be error-free;
- guest players will be suitable or reliable;
- team decisions will be fair or correct;
- payment services will always be available;
- third-party integrations will continue to operate;
- the Service will meet every user’s needs.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
23. Limitation of liability
To the maximum extent permitted by law, benchli and its owners, directors, employees, contractors, affiliates, suppliers, and partners will not be liable for:
- indirect, incidental, special, consequential, or punitive damages;
- loss of profits;
- loss of revenue;
- loss of goodwill;
- loss of data;
- business interruption;
- team disputes;
- player selection decisions;
- sports injuries;
- event cancellations;
- failed communications;
- payment provider errors;
- third-party service failures;
- reliance on AI-generated outputs.
To the maximum extent permitted by law, benchli’s total liability arising out of or relating to the Service will be limited to the greater of:
- the amount paid to benchli by you or your team for the Service in the 12 months before the event giving rise to the claim; or
- CHF 100.
None of these exclusions or the cap applies to liability for intent or gross negligence, to liability for death or personal injury, to liability to individuals under data protection law that cannot be limited, or to any other liability that mandatory law does not allow us to exclude or limit.
The exclusions for team disputes, player selection decisions, sports injuries, event cancellations, failed communications, payment provider errors and third-party service failures cover loss that benchli did not cause; they do not excuse benchli's own breach of these Terms. If we lose your team's data through our own breach of these Terms, the reasonable cost of restoring it can be recovered, within the cap above.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
24. Indemnity
If you use the Service for business purposes, or on behalf of a club, league, or organization, you agree to indemnify and hold harmless benchli, its owners, directors, employees, contractors, affiliates, suppliers, and partners from third-party claims and the resulting losses, costs, and expenses, to the extent they are caused by:
- your culpable breach of these Terms or misuse of the Service;
- unlawful content you submit;
- your unlawful or unauthorized use of personal data;
- your violation of third-party rights or applicable law.
This does not cover loss caused by benchli or its providers. benchli will tell you promptly of a claim, take reasonable steps to limit its loss, and not settle a claim in a way that imposes obligations on you without your consent. If you are a consumer, your liability is only what applicable law provides.
If you accept these Terms as the authorized representative of a club, league, or organization that is a legal person, the indemnity is owed by that club, league, or organization, not by you personally merely because you act for it. This does not affect any liability you have yourself under the law.
25. Consumer rights
Nothing in these Terms limits rights you may have under mandatory consumer protection laws.
If you are using the Service as a consumer, you may have rights that cannot be excluded by contract.
If a conflict exists between these Terms and mandatory consumer law, the mandatory consumer law will apply.
26. Changes to these Terms
We may update these Terms from time to time.
If changes are material, we will take reasonable steps to notify users, such as through the app, email, or website.
The updated Terms apply from the effective date stated in them. We tell you about a material change directly, and in good time before it takes effect, with an explanation and a copy you can keep; the change does not apply to what already happened. If you already have an account, we ask you to accept updated Terms in the Service when you next use it, and the version you accepted before applies to you until you do. Where your agreement to a change is required, we ask for it; continued use alone is not agreement to a material change that reduces your rights or adds to your obligations. If you do not agree to a material change affecting a paid subscription, you can cancel before it takes effect. Changes to the DPA follow its own change provisions.
27. Governing law and jurisdiction
These Terms are governed by the laws of Switzerland, unless mandatory law in your country requires otherwise.
Subject to mandatory consumer protection rights, disputes will be subject to the courts at the registered seat of Mitbolas GmbH.
These Terms, the Privacy Policy, and the DPA are written in English. Where we provide a translation, it is for your convenience only; if a translation and the English text differ, the English text applies.
